1. Acceptance of Terms
By accessing or using Ardaven, you agree to these Terms of Service. If you do not agree with any part of these terms, do not use the platform.
2. Description of Services
Ardaven is an AI agent platform for SMBs. The service includes:
- Custom agent design — fully configurable system prompts, with starter prompts for customer service and sales available as a starting point.
- A knowledge base that grounds bot responses in your own PDFs, Markdown, or text.
- A connector system (WhatsApp, Moloni, Google, Telegram, Slack, Discord, Notion, and optional custom connectors) that the agent can call as tools.
- An embeddable chat widget and hosted standalone chat pages.
- A multi-tenant workspace with role-based access, an admin kill switch, and a full audit log per message (model used, tokens, tool calls).
Available bots, connectors, messages, documents, and members depend on the plan you subscribe to.
3. Subscription and Payment
- Subscriptions are billed monthly.
- A one-time setup fee applies to new accounts, as listed on the pricing page.
- Prices are listed on our pricing page and may be updated with 30 days notice.
- Payment is due at the start of each billing period.
- If payment fails, we reserve the right to suspend the service after notification.
4. Customer Obligations
By using the platform you agree to:
- Provide accurate account and billing information.
- Use the service in accordance with applicable law.
- Not deploy a bot for unlawful, deceptive, or harmful purposes, including unsolicited messaging that violates WhatsApp Business policies, anti-spam law, or the ePrivacy Directive.
- Obtain the rights needed to upload content to the knowledge base.
- Comply with the policies of each connector you enable (WhatsApp, Google, Moloni, etc.).
- Keep your account credentials confidential.
5. AI-Generated Content and Human Oversight
The platform produces AI-generated responses grounded in the knowledge base you provide. You are responsible for:
- Reviewing bot instructions and tested outputs before publishing a bot to end users.
- Providing human oversight — our audit log and kill switch are available in every workspace.
- Complying with the EU AI Act transparency obligations. By default, the platform attaches an AI disclosure badge to every bot response.
Ardaven is not liable for decisions made solely on the basis of a bot's output.
6. Intellectual Property
Your knowledge-base content and configurations remain yours. You grant us a limited license to process that content solely to operate the service. Ardaven's software, branding, and platform remain the property of the company; no license is granted beyond what is necessary to use the subscribed service.
7. Limitation of Liability
The service is provided "as is". To the extent permitted by law:
- We do not guarantee uninterrupted availability.
- We are not liable for indirect, consequential, or revenue-loss damages.
- Total liability is limited to amounts paid in the 3 months preceding the claim.
8. Cancellation
- You may cancel your subscription at any time, effective at the end of the current billing period.
- After cancellation, your data is retained for 30 days for recovery, then permanently deleted unless legally required otherwise.
9. Governing Law
These terms are governed by Portuguese and European Union law. Any disputes will be submitted to the competent courts of Portugal.
10. Changes to Terms
We may modify these terms. Material changes will be communicated by email at least 30 days in advance. Continued use after the effective date constitutes acceptance.
